Fourteen of Microsoft Re-examination Challenges of Avistar's U.S. Patents Rejected by U.S. Patent Office

SAN MATEO, Calif., June 2 /PRNewswire-FirstCall/ -- Avistar Communications Corporation has received notification from the U.S. Patent & Trademark Office (the "USPTO" or the "Patent Office") that as of the close-of-business on Friday, May 30, 14 of Microsoft Corporation's requests for the Patent Office's re-examination of Avistar's 29 U.S. patents have been rejected.

Avistar is represented by Paul Carmichael as its primary licensing advisor. Among many executive assignments, Paul has served as Apple Computer Inc.'s Associate General Counsel for Patent and Trademark and Acting General Counsel, and in prior work, as IBM's Senior Corporate Counsel for Intellectual Property Law during a thirty year career at IBM.

"Data for the entire history of USPTO's re-examination activity indicate that only 8% of re-examination requests are rejected," stated Paul Carmichael. "While we believed that Microsoft's challenge to Avistar's entire U.S. patent portfolio was without merit, we also recognized that the statistics relating to us avoiding a wholesale re-examination were against us. We are delighted that the Patent Office's review has resulted in this extraordinary result which validates and strengthens many of Avistar's most important patents, We expect that the 9 patents that the USPTO has agreed to re-examine at this point also will be validated, and actually strengthened, through this process."

As discussed in Avistar's February 25, 2008 press release announcing the re-examination requests filed by Microsoft, the challenged Avistar patents have an important early priority date (1993), have already been examined over a large body of prior art, and include patents that have successfully withstood two litigations. Based on the history of these patents and the USPTO's response this week, Avistar is confident it will overcome any of the remaining re-examination requests that may be granted. Avistar patents have industry wide applicability to audio, video and data unified collaboration products and services.

Simon Moss, CEO of Avistar, stated "we are obviously pleased with the USPTO's notification that challenges to the core 14 of our U.S. patents have been rejected. We continue to remain focused on our business operations and have no further comment at this time with regards to our patent discussions."

    Forward Looking Statements

Statements made in this news release that are not purely historical, including but not limited to statements regarding Avistar's ability to overcome the remaining re-examination requests, the applicability of Avistar's patents to Microsoft's present and future products, the impact and end result of the re-examination process on the patents that are re-examined by the USPTO, are forward-looking statements within the meaning of Section 21E of the Securities Exchange Act. Such statements are subject to risks and uncertainties that could cause actual results to differ materially, including such factors, among others, as uncertainty associated with the USPTO's review and determination process, the time and expense to Avistar of responding to the re-examination requests and defending its patent portfolio, difficulties associated with enforcing or licensing Avistar's patent portfolio during the review and possible re-examination process, and the risk that Avistar's existing and pending patents could be revoked by the USPTO. As a result of these and other factors, Avistar expects to experience significant fluctuations in its licensing activities and operating results, and there can be no assurance that Avistar's future results will meet expectations. These and other risk factors are discussed in Avistar's Annual Report on Form 10-K and Quarterly Reports on Form 10-Q filed with the Securities and Exchange Commission from time to time. Avistar disclaims any intent or obligation to update these forward-looking statements.

'Rescue Me' Minisodes Burn Up the Small Screen This SummerTen Original, Standalone Minisodes Premiere June 24th on FX & Online at Sony Pictures' Crackle

LOS ANGELES, June 2 /PRNewswire/ -- The writer's strike may have delayed the fifth season return of Rescue Me until next spring, but Sony Pictures Television and FX will deliver ten minisodes of new, original content of the critically acclaimed series from Denis Leary and Peter Tolan, which will air commercial-free on FX, Tuesdays at 10 PM ET/PT beginning on June 24th.

    (Logo: http://www.newscom.com/cgi-bin/prnh/20080424/LATH509LOGO)

Each of the five-minute minisodes will feature Denis Leary and the rest of the show's ensemble cast in weekly comedic, standalone episodes, and will be available the day following the FX telecast on Crackle.com (http://www.crackle.com/rescueme) and via SPT's The Minisode Network on other online and mobile partners.

"Fans of Rescue Me have come to expect their favorite show to run during the summer, but because of the delay in production due to the writer's strike that wasn't a possibility," said John Landgraf, President and General Manager, FX Networks. "These minisodes are hysterical and will provide fans the opportunity to enjoy the characters they have come to love. The minisodes are designed to keep the series top-of-mind in preparation for next season's 22 consecutive episodes, which will be an unprecedented single-season run of a scripted series on basic cable."

"Denis, Peter, Jim Serpico & their team were enthusiastic about keeping the show salient, and this is a smart way to give viewers their much needed Rescue Me fix this summer," said Zack Van Amburg, co-president, programming and production, Sony Pictures Television. "It's an added bonus that we'll be able to leverage the studio's existing digital network to deliver the minisodes to a vast online audience," added co-president Jamie Erlicht.

The minisodes will feature Rescue Me's regular cast, which in addition to Leary includes: Adam Ferrara, Michael Lombardi, Steven Pasquale, Andrea Roth, John Scurti, Daniel Sunjata, and Callie Thorne. Some of the storylines fans can anticipate are: Sean (Pasquale) struggling to hold up to his fast in the face of great adversity -- Lou's (Scurti) homemade doughnuts; the gang discussing their criteria for a good bar; and Tommy's (Leary) erotic fantasies taking a turn for the worse, much to the delight of his ball-busting bunkmates. They will be written by Leary, Peter Tolan, and Evan Reilly, and will be directed by John Fortenberry.

The episodes will be available online at Crackle (http://www.crackle.com/rescueme), YouTube (http://www.youtube.com/minisodenetwork), MySpace (http://www.myspace.com/minisodenetwork), AOL Video (http://video.aol.com/video-category/the-minisode-network/110600), Hulu, Tidal TV, Joost, and exclusively on mobile at Sprint TV.

The Rescue Me minisodes mark the second time that Sony and FX have provided original, standalone content for the series. In 2006, as promotion for season three, they teamed with Leary and Tolan to deliver Rescue Me 2.5, a 15-minute episode which ran online and was added to the third season DVD.

Rescue Me revolves around the lives of the men in a New York City firehouse, the crew of 62 Truck. Examining the fraternal nature and relationships of firefighters, the series tackles the daily drama of the life-and-death situations associated with being a firefighter, while exploring the ways the men use dark humor to protect their true emotions. Rescue Me was created by Leary and Tolan, who serve as executive producers along with Jim Serpico. The show's fifth season is set to premiere on FX in April 2009.

In 2006 & 2007, Denis Leary was recognized with an Emmy(R) Award nomination for "Outstanding Lead Actor in a Drama Series." In 2005, both Leary & Peter Tolan were nominated for Emmy(R) Awards in the category of "Outstanding Writing for a Drama Series" for their work on Rescue Me's pilot. Tolan was also nominated for "Outstanding Directing for a Drama Series" for the same episode. That same year, Rescue Me was an official television selection of the AFI Awards, and the Producer's Guild Awards also recognized the show with the Visionary Award. The series is produced by Apostle Pictures, The Cloudland Company and DreamWorks Television in association with Sony Pictures Television.

Safety Promoted on Roadways June 2-6Wireless Safety Week Encourages Alabama Travelers to Practice Safe Driving

BIRMINGHAM, Ala., June 2 /PRNewswire/ -- The roadways can be a dangerous place. Each year, the Cellular Telecommunications Industry Association (CTIA) designates one week as Wireless Safety Week to raise awareness of safety issues involving wireless communications -- including driving while using a cell phone.

This year, Wireless Safety Week is June 2-6 -- just as students finish up their semester and families venture out for summer vacation. With more than 208 million cell phone users in the U.S. today, Verizon Wireless encourages Alabamians to be vigilant during Wireless Safety Week and beyond to reduce the number of cell phone-related accidents.

The Alabama Department of Public Safety reports that unfortunately in Alabama, the amount of accidents on public roadways have increased by 15% between 2003 and 2004 with 1,001 and 1,154 vehicle accident deaths respectively. With the number of cell phone-carrying drivers increasing by the minute, there is no doubt that the number of accidents continues to rise -- especially with the increased popularity of text messaging as a means of communication. In fact, the National Highway Traffic Safety Administration estimates that cell phone use contributes to 25 percent of all vehicle crashes today.

"We want all Alabamians to enjoy traveling and remember to use caution on roadways," says Jeff Mango, president of the Alabama/Georgia Region for Verizon Wireless. "Our goal for Wireless Safety Week is to highlight ways consumers can stay safe on the roads."

Verizon Wireless is currently working with the Alabama Department of Transportation, the Alabama Department of Tourism and the Alabama Chapter of the National Safety Council to distribute free wireless ear buds to travelers while supplies last; during Wireless Safety Week at all eight of Alabama's Welcome Center locations and at defensive driving courses held around the state. A map of the Alabama's Welcome Center locations can be found online at http://www.dot.state.al.us/.

Other tips for driving responsibly not only during Wireless Safety Week, but all year round include:

-- Remember -- safe driving is always your first responsibility when behind the wheel. -- Before you leave the curb: -- Activate your voicemail service -- if traffic conditions prevent you from answering a call, you can always retrieve messages later. -- If you're taking advantage of any navigation service, program the address into your phone before you leave -- then you'll only need to listen to the directions. -- Program important and frequently dialed numbers into your phone to take advantage of speed dialing and voice dialing features on your phone. -- When using a portable music device or music-enabled cell phone, set up your playlist while stopped. -- Turn your phone on speakerphone or use a headset while driving. Bluetooth devices are designed specifically for this type of use. -- Avoid taking notes or write down phone numbers while driving. Rather, pull off the road to a safe spot or leave yourself a message on your voicemail or voice-memo-capable handset. -- Never view or send text messages, or video downloads while driving. The new device is targeted at Datacom, Telecom, Servers, and Storage markets, specifically, SONET/SDH, 10GeB FEC, 10GeB LAN PHY, and Add-drop MUXs applications. HONG KONG, June 2 /Xinhua-PRNewswire-FirstCall/ -- Fourteen buyers with combined annual sales of US$204 billion met 45 Greater China suppliers pre-screened by Global Sources at Private Sourcing Events (http://www.privatesourcingevents.com/) for gifts & novelties and personal care & health products. The events were held in Shenzhen on May 22 and May 28, respectively.

    (Logo: http://www.xprn.com/xprn/sa/200708071747.jpg )

Six buyers participated in the Gift & Novelties Private Sourcing Event, namely:

-- Brookstone -- one of the largest US specialty retailers -- Carlsberg -- one of the world's largest brewery groups -- Li & Fung -- sourcing on behalf of Toys "R" Us, one of the world's leading retailers of toys and baby products -- Office Depot -- one of the world's largest office product retailers -- RadioShack -- the third-largest US electronics chain -- Test Rite -- Taiwan's largest trading group

Eight buyers participated in the Private Sourcing Event covering personal care and health products:

-- Dairy Farm -- a leading pan-Asia retailer of foods and durable consumer goods -- Dollar General -- the largest retailer in the US by number of store locations -- Kaufland -- the largest hypermarket chain in Germany -- Kesa Electricals -- Europe's third-largest electronics retailing group -- Li & Fung -- the world's leading buying agency for consumer goods -- Otto International -- a professional trading organization and part of the Otto Group, one of the leading international trading and services groups -- Test Rite -- Taiwan's largest trading group -- Woolworths UK -- one of the UK's largest retailers on home, family and entertainment.

Global Sources' Chairman and CEO, Merle A. Hinrichs, said: "Across our specialized online, trade show and print channels, we save buyers' time by offering them highly focused sourcing opportunities with suppliers already verified and ranked based on the amount of information they've provided.

"Private Sourcing Events take this to the next level by focusing on specific products. Invited suppliers have been verified by Global Sources and pre-screened by each buyer. Not only does this reduce the time it takes to source products, it aims to reduce the high cost involved in identifying and qualifying suppliers."

One buyer, Senior Procurement Officer of Carlsberg Procurement, Dick Man, said: "This is incredibly convenient. We were able to accomplish in one day what usually takes several weeks."

One supplier, Director of International Department for Softto Company Ltd, Linda Li, said: "We had some very productive meetings. Instead of general buying teams, we met with specialized buyers from each company responsible for sourcing the kind of products we make."

Circuit City stores carry models from major brands including Garmin, Magellan, Mio, Sony and TomTom, with a wider selection available at http://www.circuitcity.com/.

"There's no doubt about it, enhanced electronics are now an essential part of the American automotive experience," said Irynne MacKay, Circuit City's senior vice president and general merchandise manager for entertainment and mobile products. "Dads and moms count on electronics not only to help them find their way, but also to entertain the family on a trip."

Additional results from the Circuit City survey: -- 30 percent of dads rated portable DVD players as "very important" for a family road trip (25 percent rated built-in DVD as "very important") -- 27 percent of dads rated laptop computer as "very important" for the road trip -- 24 percent rated an MP3 player "very important" for the trip -- 23 percent rated handheld games "very important" for the trip -- 20 percent said upgraded car stereo would be "very important" for the trip

More than 4,100 dads responded to the survey, which was conducted for Circuit City by independent research firm Decision Analyst, Inc. of Arlington, TX. The survey's margin of error is plus or minus two percentage points.

ARM Mali-400 MP Technology Brings High-End Graphics Performance to All Consumer DevicesMulticore Graphics Solution Revolutionizes User Experiences With Pioneering Scalability

CAMBRIDGE, England, June 2 /PRNewswire-FirstCall/ -- ARM (; ) today announced the ARM(R) Mali(TM)-400 MP scalable multiprocessor graphics solution, capable of delivering performance of up to 1G pixels per second and enabling licensees to serve multiple product markets with the same architecture, whilst retaining the flexibility to choose the optimum power, performance and area configuration for their application. The pioneering Mali-400 MP architecture offers breakthrough scalability, also reducing costs for developers and OEMs associated with platform fragmentation, as no changes are required to support one to four processors.

"Architectural reuse of software and hardware components is of increasing importance to SoC developers," said Frank Dickson, co-founder and chief research officer, MultiMedia Intelligence. "The scalability of the ARM Mali-400 MP GPU, from 300 million to over 1 billion pixels per second, will enable OEMs to deliver a wide range of market-leading products on the same underlying architecture, reducing their total cost of ownership and maximizing ROI."

The ARM family of Mali GPUs is opening up new product markets that will benefit from graphics acceleration, from mobile feature phones through to 1080p-based iDTVs. Recent Mali GPU licensees in the set-top box market mean that the consumer experience in the home is set for a radical change.

"We see an increasing need for pixel processing of up to 1G pixels in the home as HD screens become ubiquitous," said Ola Larsen, vice president of marketing at TAT, an ARM Mali Developer Relations Program Partner. "The set-top box and digital TV user interface will never be the same once graphics acceleration such as Mali technology becomes the standard."

The Mali-400 MP solution builds on ARM's experience and knowledge gained in the widely-adopted ARM MPCore(TM) technology, implemented in the ARM11(TM) MPCore and Cortex(TM)-A9 MPCore multicore processors, designed to reduce system bandwidth, optimize performance and reduce power consumption.

"The battle for consumers' attention across all consumer electronics product markets means that the graphics acceleration capability of these devices is rapidly becoming a must-have feature. Consumers expect an equally compelling user experience when accessing content from their mobile and digital home entertainment devices," said Michael Dimelow, director of marketing, Media Processing Division, ARM. "The ARM Mali-400 MP graphics solution enables our customers to bring scalable graphics processing performance to a wider range of product markets and more economically than before."

Power consumption and area efficiency are key aspects of the Mali-400 MP GPU design. The ability to scale performance to meet different price points and power budgets allows the Mali-400 MP GPU to address the widest possible market while bringing significant cost benefits through utilizing the same single software stack across multiple devices.

The ability to capture the attention of consumers through the display on their electronic devices, as demonstrated by a range of high-end designs today, is driving the need for hardware graphics acceleration in a wide range of consumer devices. The scalable multicore graphics processing design of the Mali-400 MP solution will help bring graphics acceleration to almost any device with a screen.

The United Kingdom's Royal Institution of Chartered Surveyors Uses Autonomy Meridio to Improve Regulation of Member FirmsPartners With Kainos to Deliver New Case Management Solution

CAMBRIDGE, England and BELFAST, June 2 /PRNewswire-FirstCall/ -- Autonomy Meridio , the leading provider of policy-based retention and disposition management software for the enterprise, today announced that the United Kingdom's Royal Institution of Chartered Surveyors (RICS) has implemented its records management solution to more effectively regulate UK surveyors firms. Autonomy Meridio's records management solution is a critical component of RICS' new case management solution that makes the information related to the investigation and handling of cases brought against surveyor's firms more transparent and consistent. RICS estimates that the new system can save more than GBP250000/annum in manual processing and analysis costs. Meridio partner, Kainos, was the Systems Integrator, for the project.

RICS is the leading organisation of its kind in the world for professionals in property, land, construction and related environmental issues. As part of its role, it helps to set, maintain and regulate standards. It has 140,000 members, operating out of 146 countries and regulates some 12,000 surveyors firms across the UK.

To better comply with the new rules introduced by RICS, it was necessary to implement a new records management solution and new storage processes to ensure that the data relating to the investigation of all cases are easily accessible by authorized users and one that can scale to meet its increasing business demands. RICS commissioned Meridio's partner, Kainos, to help integrate a solution that enables it to manage and track all case-related documents and correspondence, including emails, faxes, letters and phone calls. The solution, which is based on Autonomy Meridio's records management solution, allows RICS to convert documents from paper-based to electronic format, and includes an email gateway for efficient routing of in-bound emails. Kainos helped RICS to design a customized user interface that seamlessly integrates with existing RICS systems.

Since the implementation, RICS' staff members now have easy access to the most up-to-date and relevant case information, regardless of their locations, allowing them to provide a higher level of service and respond to queries quickly and consistently whilst managing many more cases than could previously be handled. The case documentation is categorized by firm, member and ID and provides a very transparent and audit proof system for tracking case information and supporting documentation.

Commenting on the project, Jon Freeman, senior project manager of RICS said, "Kainos worked with us as our partner in this project and they were professional and responsive. We were also impressed by their extensive knowledge of the Autonomy Meridio product. The case management solution has taken the complexity out of the regulation process and has resulted in better service delivery and a more effective operation."

"All global organisations now have to deal with the increasing large volume of electronic documents, including correspondence in many different formats, which can be overwhelming to IT departments," said Nigel Hutchinson, CEO of Autonomy Meridio. "The Autonomy Meridio's records management solution can help customers to manage this information efficiently whilst meeting regulatory responsibilities and delivering a high level of customer service. We are very pleased to partner with Kainos to power RICS' new case management solution, allowing it to comply with the new legislation and deliver significant business benefits to the organisation."
